10月17日，提出S386法案的参议员Mike Lee针对S386的第四次UC在Senator Durbin的反对下再次失败。但是，Mike Lee表示，他会不断尝试，尽各种努力全力推动这个法案。
与上次S386UC前去往DC 国会山发传单和参加Durbin早餐会的华人人数形成鲜明对比，这次去反对的华人寥寥无几。
所以，请相信，公平必胜！S386追求的是各种族间的公平平等，这正是我们当下最大的诉求！

无论是等待排期中的，还是即将要提交申请的申请人，甚至包括留学生，很多人已经醒悟：S386是解决排期漫长问题的救命法案！

在美永久居民、公民及后裔
S386伤及了这部分同胞的利益了吗？
任何人都不愿与背水一战的“死士”做敌人对吗？为了等待绿卡排期几十年的印度码农，被迫不惜一切代价保工作，他们永远处在背水一战的绝境中。因此，无形中他们便成为其他种族最强力的竞争对手。
除了拼命工作，保卡为先的印度民工，被迫自愿接受更低的工资。华人的后代，如果想进入IT行业,首先将面临这些不得已而为之的行业内不正当竞争。公平何在？
可以改善目前这种对在职华人和华人后代极端不利环境的，正是S386！
S386追求的是最基本的公平：不论你来源国大小，公平排队，先来先得！
由于不公平的排期规则导致被积压多年的在美华人和印度人群体，藉由S386使得积压获得清理、拼命许久的印度工人终于不再身处绝境，印度码农议价能力得以提高。与此同时同在职场的华人及其后代将在公平的议价环境里，去拿到本该属于自己的高工资！
S386严格审查H1b
在S386/HR1044（众议院对应法案名称）中，特别加入了严格审查H1B的条款，可以起到有力阻挡后来的H1B灌水大军的同时还可以大力度清理从前的灌水大军。
S386的这些增补条款，是自从H1B制度被创建以来，美国首次通过立法的方式，有效打击灌水H1B的一次重拳出击！条款包括保护举报人，加大处罚力度，赋予劳工部权力便捷调查（例如直接获取H1B雇员的税务申报表）和查处H1B造假问题，对于H1B依赖型雇主进行年度审计等等。
这些条款的加入，得益于美国共和党大佬，前参议院立法委员会主席GRASSLEY。他是坚定的美国保守派，不遗余力保护美国人的就业岗位和薪资水平，对H1B欺诈造假深恶痛绝。S386的提出者MIKELEE,经过与前主席的艰苦谈判，双方一致同意加入了这些增补条款，才有了S386的第一次UC闯关。
