去年11月底在西雅图退房的时候被房东非法扣了$390的押金(Security Deposit)。
其中扣了两项清洁的费用,但是我退房的时候打扫得很干净。
我了解了相关法律之后,果断写威胁邮件。
以下是我发的邮件:
When I moved out of rental Unit ABC on YYYY/MM/DD under Lease 9999999, the unit was returned to its original condition minus normal wear and tear. However, I did not receive my full security deposit. My main issues in the list of charges are the two cleaning charges listed at $200 for Clean & Bright Cleaning 1x1 and $190 for the carpet cleaning, which combined to be $390.
Seattle Residential Landlord-Tenant Act Section RCW 59.18.280(1) says the landlord shall include "a full and specific statement of the basis for retaining any of the deposit" and "a copy of a bill, invoice, receipt, vendor price list, or other vendor document that reasonably documents the cost of the item used in the repair or cleaning of the unit" within 30 days after the termination of the rental agreement. It has been more than 30 days and I have not received any statement nor any copies of bills, invoices, or receipts that documents that reasonably substantiate the cleaning charge of $200 for a 1 bedroom rental unit.
The Landlord-Tenant Act RCW 59.18.280(1)(c)(ii) says that no deposit may be withheld for carpet cleaning unless the landlord documents wear to the carpet that is beyond wear resulting from ordinary use of the premises. A pre-inspection was performed on YYYY/MM/DD and the inspector confirmed the carpet was in good condition.
The Landlord-Tenant Act RCW 59.18.280(2) says if you fail to provide the necessary documentation and statement within 30 days after the termination of the rental agreement, you are liable to refund $390 of my deposit. Today’s date is YYYY/MM/DD, and I have received no word from you. Therefore, I will expect my deposit in the amount of $390 by YYYY/MM/DD. If I do not receive my deposit by YYYY/MM/DD, I have the right to ask for twice my deposit amount in small claims court.Please mail $390 without delay to the address below:Your Address
几天之后,就把$390的支票寄到我家了。
总体来说西雅图因为左翼政治的原因,对租房的同学们还是很友好的,以后如果遇到这种事可以借鉴一下。
我退房的时候还是太急了,下次会注意退房前拍照留证据,这样万一打官司更加证据确凿。
