德州或将禁止华人购置房地产，全美华人华侨，团结起来，抵制开历史倒车的SB147法案

近期媒体报道，2022年11月22日，德州参议员Lois W. Kolkhorst在德州议会引入SB147法案，拟将禁止中俄朝伊公民、法人或政府在德州购买房地产。该法案引发了全美和全德州的华人华侨的关注。新闻链接：

历史背景

这一歧视性法案在美国历史上并不是第一次出现。

19世纪末，《排华法案》禁止中国劳工移民后，日裔移民逐渐增多，逐渐威胁到白人农场的经济利益。因此，从加州1879年开始，各州逐渐颁布了总计多达24项禁止移民购买土地的歧视性州法，统称为《外国人土地法》（Alien Land Laws）。其中德州于1819年，1892年和1921年三次通过歧视性的《外国人土地法》限制非公民持有土地。

尽管第14修正案的平等保护条款早在1868年就通过生效，但是直到1948年联邦最高法院的Oyama v. State of California, 332 U.S. 633 (1948)才宣告这些歧视性的《外国人土地法》违宪无效。

现实背景

2021年新冠疫情以来，针对亚裔的仇恨犯罪和事件显著增加。《抵制针对亚裔的仇恨犯罪和种族歧视》。2021年4月3日，郭律师和小伙伴儿们在德州议会前组织了#StopAsianHate集会。

去年九月，佛罗里达州州长（也是2024年共和党总统候选人的热门人选）Ron DeSantis提议立法限制包括中国在内的七国购买佛罗里达农用地和军事基地附近的土地。新闻链接：

跟DeSantis提议的立法相比，德州参议员Kolkhorst的SB147法案虽然限制的国家较少，但是限制的范围增加了很多，尤其增加了对个人和法人的限制，以及没有限定农用地或军事基地附近土地，即华人华侨最喜欢的住宅，甚至商用地也会受限。

2021年，同样是在德州，州长Abbott签署生效了《孤星州基础设施保护法》（Lone Star Infrastructure Protection Act）禁止一切外国公司与关键基础设施的合同。

去年10月由Defend Texas Liberty PAC进行的一项共和党投票者的民意调查显示，82% 的共和党选民同意“德州应该禁止中国政府或中国公民在该州购买土地。” 只有 10% 的人说不应该。

据2022年全美房地产经纪人协会的一份报告，2021年3月至2022年3月间，中国投资者在美国房地产上投入了60亿美元，占外国买家总投资额的6%。最大的外国买家来自加拿大和墨西哥。

违法违宪

毋庸置疑，SB147法案如果通过签署生效，会是违法违宪的恶法。SB147法案显然违反以下联邦法：

美国宪法第十四修正案的平等保护条款
《公平住房法》（Fair Housing Act）
废除《外国人土地法》（Alien Land Laws）的各个联邦最高法院和州法院判例，如Oyama v. State of California, 332 U.S. 633 (1948)等。

更不要说SB147法案是非常种族歧视的。

On November 14, 2022, state Senator Lois W. Kolkhorst introduced Senate Bill 147 aiming to ban citizens, governments and entities of countries including China from purchasing real property in Texas.[1] This bill, while early in the state legislative process, has invoked outrage in both national and local Asian communities.
Discrimination in housing and real estate transactions against people of Asian heritage is not news in U.S. history. The infamous Alien Land Laws originated from California in 1879 throughout the Union – including Texas in 1891, 1892, and 1921 - that traced their roots from the anti-Asian racism in U.S. history manifested in discriminate bills and incidents: the Page Act of 1875, Chinese Exclusion Act of 1882, the Immigration Act of 1917 and Asiatic Barred Zone, the Immigration Act of 1924 and the national origin quota, the Internment of Japanese Americans, the 1992 Los Angeles riots, and countless of lynching against Asian Community including the murder of Vincent Chin, etc.
Against the backdrop of past years’ anti-Asian rhetoric and a sharp increase in hate crimes and incidences during the COVID-19 pandemic, Senate Bill 147 raises alarms in both Asian American communities and the nation as a whole on visible and invisible discrimination against people of Asian heritage.
Similar to the Alien Land Laws in the 19th and 20th centuries, Senate Bill 147, if in effect, is discriminatory, unlawful, and unconstitutional. It is against the Equal Protection Clause of the 14th Amendment of the U.S. Constitution, U.S. Const. amend. XIV. §1, it is against the Fair Housing Act, 42 U.S.C. 3601, et seq., it is against various Federal and State case laws overruling the Alien Land Laws including but not limited toOyama v. State of California, 332 U.S. 633 (1948). Senate Bill 147, if in effect, is against the law of the land.
We call on the Texas Legislature not to pass Senate Bill 147 and to censure state Senator Kolkhorst. We also call on Governor Abbott to veto the bill should it pass the state legislature.
